New Law Allows Management to Distribute Annual MRL Copies Electronically
Please be aware that Assembly Bill 391 was signed into law and would allow mobilehome park residents to receive their annual copy of the Mobilehome Residency Law electronically rather than in print.
AB 391 will become effective January 1, 2026, and park management MUST receive a written (or emailed) request from residents requesting electronic copies of the MRL. If a resident still wants a physical copy, management MUST provide one, and physical copies will be available for purchase online soon.
Agreement to Accept Delivery of Annual MRL Notices Electronically and Separate Notice from Park as Attachment
These are two new forms. For 2026, California Civil Code Section 798.14 was amended and provides that a homeowner or resident may agree to accept the annual notices from the park due by February 1 each year (see Civil Code Sections 798.15(c), 798.15(i), and 798.43.1) electronically, rather than by personal service or mail. The change to Section 798.14 only applies to these annual notices and not any other notices under the MRL. The park must have written consent from the homeowner or resident and must also provide separate notice within five days of written consent with specific language from Section 798.14 in the actual notice to comply with this new law for 2026. As a result, we prepared two forms, a consent form and notice form which is intended to be an attachment to the consent form. We recommend the park fill out the attached notice form and include it with the consent form as an attachment which covers both the consent from the homeowner/resident and notice provided by the park. This way when the homeowner/resident signs the consent form they are also being given notice from the park at the same time. Otherwise, if you do not use the notice attachment form concurrent with the consent form, the park would need to provide that notice form personally or by mail within five (5) days of written consent from the homeowner/resident. The park should also prepare a proof of service to keep in the park’s records confirming when the notice was personally served with the consent form wherein service would be the same date as the consent form executed by the homeowner/resident.
