Supreme Court Reinstates Stay for Vaccine Mandate for Large Businesses By Manufactured Housing Institute
Today, the Supreme Court blocked the
Administration’s COVID-19 vaccine-or-test mandate
for workers at large private businesses. The
mandate required that workers at businesses with
100 or more employees must get vaccinated or
submit a negative COVID test weekly to enter the
workplace. It also required unvaccinated workers
to wear masks indoors at work.

This action by the Supreme Court puts the “stay”
of the rule originally lifted by the United
States Court of Appeals for the Sixth Circuit
back in place. While this action returns the
vaccine mandate legal challenges to lower courts,
the ruling suggests that the Supreme Court is
likely to rule against the business rule if the
case reaches the court again.
Throughout the legal challenges, MHI has been

businesses calling on OSHA to make immediate
changes to the mandate.
