Important CMHI Bulletin Regarding Formaldehyde
Title 17, Section 93120.2 of the California Code of Regulations (CCR) details new Formaldehyde Emission Standards for hardwood plywood (HWPW), particleboard (PB), medium density fiberboard (MDF) and thin medium density fiberboard (TMDF). The new emission standards became effective on January 1, 2009.
Emission standards for hardwood plywood and particleboard, used in manufactured housing, must comply with the standards prescribed in Section 3280.308 of the HUD Code and are therefore exempt from the new requirements prescribed in Section 93120.2 CCR.
The HUD Code does not address emission standards for MDF; therefore, MDF and TMDF when used in manufactured housing is not exempt and must comply with the new standards prescribed in Section 93120.2.
***VERY IMPORTANT***
“The Sell-Through” provisions of Section 93120.2 stipulate that “Finished Goods (manufactured homes)” that are not in compliance with the Phase One Standards that became effective on January 1, 2009 may not be sold for use in California after June 30, 2010 regardless of the date the “Finished Goods (Homes)” were fabricated.
In other words, manufactured housing retailers have eighteen months from January 1, 2009 to sell any inventory that is not in compliance with the Phase One Standards for medium density fiberboard and thin medium density fiberboard. Beginning July 1, 2010, any non-compliant homes n retail inventory will need to be sold for use out of the State of California or retrofitted for compliance with Section 93120.2 for use in the state.
